The United States has initiated an investigation into subsidies on frozen warm water shrimp imported from Vietnam. In response, Vietnam’s Ministry of Industry and Trade has taken swift action by selecting a legal consulting unit to guide and support the government throughout the investigation process.
Ensuring Compliance and Efficiency
The primary objective of this legal consulting unit is to ensure that all actions taken by Vietnam adhere to trade remedy regulations and maintain utmost efficiency. The government is committed to taking full responsibility for its decisions in this matter. In the event of any challenges or complications, the unit will propose solutions in accordance with relevant regulations.
The anti-subsidy investigation by the US was initiated in November 2023, and preliminary conclusions are anticipated in May 2024. Given that the government is a key party under investigation, Vietnam’s Ministry of Industry and Trade has been closely collaborating with industry associations and businesses to formulate an effective response strategy.
The Complex Nature of the Case
One of the major challenges in this investigation is the complexity of the case. It involves a total of 40 subsidy programs spread across different provinces, stringent deadlines, detailed information requests, and a substantial need for document translation. Pursuing this lawsuit incurs both tangible and intangible costs, encompassing legal fees, translation expenses, information collection efforts, opportunity costs, and the potential effects on shrimp exports.
Given the multifaceted nature of the case and its potential implications, businesses involved in the shrimp industry must make a judicious evaluation of the costs and benefits before deciding to participate.
